Terms of service
Last updated: [date to be confirmed at launch]. These terms are a legal agreement between you and K3-Team Pty Ltd. By creating an account or using the service you agree to them. If you do not agree, do not use the service.
1. Who we are and eligibility
The service is provided by K3-Team Pty Ltd [ABN to be inserted] ("Next Role", "we", "us" or "our"). You must be at least 18 years old and able to enter into a binding contract to use the service. If you use the service on behalf of an organisation, you confirm you are authorised to bind it.
2. What the service is
Next Role is a software tool. It helps you organise applications, tailor your own CV, and draft your own cover letters and replies, and it can help you complete applications in your own browser where you turn that on. We provide the tool only. We are not your agent, employer, recruiter, or career, migration or legal adviser, and we do not apply for jobs or contact employers on our own behalf. We do not promise that you will receive interviews, offers or employment.
3. Your account
You are responsible for your account, for keeping your password secure, and for everything done through your account. Tell us promptly at [email protected] if you suspect unauthorised use. You are responsible for the accuracy and legality of the information you enter, and you confirm you have the right to use and share it.
4. Your third-party accounts are your responsibility
The service can interact with third-party websites, job boards, email providers and employers ("third-party services"). Your accounts and relationships with those third-party services are yours alone. You are solely responsible for:
- your own accounts, logins and activity on any third-party service;
- complying with the terms, policies and rules of each third-party service, including any limits on automated access or applications;
- the content you submit, send or apply with through the service; and
- any consequences of using the service with a third-party service, including suspension, restriction or closure of your accounts there.
We do not control third-party services, are not responsible for them, and do not endorse them. Any action the service takes with a third-party service is taken by you, on your instruction, using your own account and browser. To the extent the law allows, we are not liable for any loss connected with your use of, or any third party's treatment of, a third-party service or account.
5. The browser extension and completing applications
The optional browser extension runs in your own browser and acts on your instruction. Capturing job details and completing applications happen in your session, using your own accounts. Submitting an application is off by default; it happens only if you turn the submit setting on, and you remain responsible for reviewing what is submitted. You must make sure your use of the extension is permitted by each website you use it with. You may pause or remove the extension at any time.
6. Acceptable use
You agree not to misuse the service, including not to: use it unlawfully or for an unlawful purpose; enter information you have no right to use; interfere with or attempt to breach the security of the service; use it to send spam or harass anyone; reverse engineer, copy or resell the service except as the law requires; or use it in a way that could damage or overload it or harm others.
7. AI output
Some features generate content using AI. AI output can be inaccurate, incomplete or unsuitable. It is not professional, legal, migration or career advice. You are responsible for reviewing, correcting and deciding whether to use any output before you rely on it, send it or submit it.
8. Fees, trials and cancellation
Paid plans and any free trial are described at sign-up and on our billing pages. Prices are in Australian dollars and, where applicable, include GST. Payments are processed by our payment provider; we do not receive or store your full card details. Subscriptions renew automatically until cancelled. You can cancel at any time, effective at the end of your current billing period. Except where the law requires, fees already paid are non-refundable, and we may change prices or plans on reasonable notice.
9. Intellectual property
We and our licensors own the service, including its software, design and content, and nothing in these terms transfers that ownership to you. You keep ownership of the content you enter. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, display and otherwise use your content as reasonably necessary to provide, secure and improve the service and as described in our Privacy policy.
10. Disclaimers
To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free or secure, that it will meet your requirements, or that it will lead to any particular job-search outcome. You use the service at your own risk.
11. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Where our liability for failing to comply with such a guarantee can be limited, our liability is limited, at our option, to re-supplying the relevant services or paying the cost of having them re-supplied.
12. Limitation of liability
Subject to clause 11, to the maximum extent permitted by law: we are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, opportunity, data or goodwill, however arising; and our total liability to you for all claims connected with the service is limited to the amount you paid us for the service in the 12 months before the event giving rise to the claim, or AUD 100 if you have paid us nothing.
13. Indemnity
To the extent permitted by law, you agree to indemnify us against any loss, cost or claim arising from your breach of these terms, your misuse of the service, the content you provide, or your use of any third-party service.
14. Suspension and termination
You may stop using the service and delete your account at any time. We may suspend or end your access if you breach these terms, if we reasonably suspect misuse, or if we stop offering the service. On termination, your right to use the service ends; clauses that by their nature should survive will survive.
15. Changes to these terms
We may update these terms from time to time. The current version is always the one published here. If we make a material change we will take reasonable steps to let you know, and your continued use of the service means you accept the updated terms.
16. Governing law
These terms are governed by the laws of Western Australia, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State.
